Local Bankruptcy Rules — District of Kansas

Educational reference covering the Local Bankruptcy Rules (LBRs) promulgated by the U.S. Bankruptcy Court for the District of Kansas: where to download the official rules, the structure of the rule set, and several local-rule provisions that pro se filers commonly need.

What the Local Bankruptcy Rules do

Each U.S. bankruptcy court adopts Local Bankruptcy Rules under the authority of Federal Rule of Bankruptcy Procedure 9029 and 28 U.S.C. § 2071. The Local Rules supplement (they do not displace) the Federal Rules of Bankruptcy Procedure (Fed. R. Bankr. P.) and the Bankruptcy Code (11 U.S.C.). They govern day-to-day procedure: formatting of pleadings, hearing scheduling, motion practice, electronic filing, and chambers procedures.

The District of Kansas LBRs are codified as D. Kan. LBR 1001 through 9037, mirroring the chapter and rule structure of the Federal Rules.

Local-rule highlights for pro se filers

The provisions below are common touchpoints. They are summarized for orientation only; the official PDF controls.

D. Kan. LBR 1002 — Petition

Implements Fed. R. Bankr. P. 1002 on petition filing. Pro se debtors typically present paper petitions at one of the three divisional clerk's offices (Wichita, Topeka, Kansas City) unless using the court's electronic filing for self-represented litigants for post-petition documents.

D. Kan. LBR 2002 — Notices

Supplements Fed. R. Bankr. P. 2002 governing notices to creditors. Specifies the Bankruptcy Noticing Center (BNC) as the default noticing channel.

D. Kan. LBR 3015 — Chapter 13 Plans

Governs Chapter 13 plan format. The District of Kansas uses the national Official Form 113 for Chapter 13 plans (see Fed. R. Bankr. P. 3015.1 conditions). Confirmation procedure and standing-trustee submissions are addressed in this rule.

D. Kan. LBR 4001 — Stay Relief and Cash Collateral

Implements Fed. R. Bankr. P. 4001 on motions for relief from the automatic stay (11 U.S.C. § 362) and use of cash collateral (11 U.S.C. § 363).

D. Kan. LBR 5005 — Filing Papers (CM/ECF)

Authorizes electronic filing through CM/ECF and addresses signatures, file format (PDF), and service. Pro se filers may use Electronic Filing for Self-Represented Litigants (EFSS) for certain post-petition documents.

D. Kan. LBR 9011 — Signatures and Sanctions

Tracks Fed. R. Bankr. P. 9011, which mirrors Fed. R. Civ. P. 11. Every paper submitted to the court — signed by an attorney or by a pro se party — is a representation that the filing is well grounded in fact and warranted under existing law.

D. Kan. LBR 9037 — Privacy Redactions

Implements Fed. R. Bankr. P. 9037 on personal-data redaction. Filers must redact full Social Security numbers (last four digits only), full taxpayer-identification numbers, full birth dates (year only), and minor children's names (initials only) from filed documents.

General Orders

Beyond the LBRs, the court issues General Orders that supplement specific procedures (for example, mortgage modification mediation, chapter-specific scheduling templates, or temporary measures). The current set is published on the court's General Orders page.

Pro se filers should also review the pro se reference page for clerk's-office contact information and the forms reference for the official-form set used in D. Kan. cases.
